Terms of Service

1. Acceptance of Terms

By accessing or using the We Nation South Africa website (wenationsa.org), platform, or any related services (collectively, "the Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations of the Republic of South Africa.

If you do not agree with any of these Terms, you must not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

These Terms should be read together with our Privacy Policy.

2. About We Nation South Africa

We Nation South Africa is a registered Non-Profit Company (NPC) under the laws of South Africa (Reg No: 2025/868936/08). We Nation is an independent, non-partisan civic platform operating in the public interest. We are not a political organisation and not a charity defined by handouts.

3. Use of the Platform

You may access and use the Platform only for lawful purposes. You agree not to:

  • Use the Platform in any way that violates applicable local, national, or international law or regulation
  • Attempt to gain unauthorised access to any portion of the Platform or any connected system
  • Use the Platform to transmit unsolicited messages, spam, or harmful content
  • Introduce viruses, malware, or any other malicious code
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Reproduce, distribute, or republish We Nation content without prior written permission
  • Attempt to reverse engineer, decompile, or disassemble any software on the Platform

4. Donations

All donations made through the Platform are processed by a secure third-party payment provider. By making a donation:

  • You confirm the donation is lawful and made from funds you are entitled to use
  • All donations are final and non-refundable unless We Nation determines otherwise at its sole discretion
  • We Nation reserves the right to refuse or return any donation at its discretion
  • Section 18A tax receipts will be issued to eligible donors by email — retain these for your tax records
  • We Nation will apply donations in accordance with its objectives as an NPC

5. Membership

Membership is subject to a separate Membership Agreement which will be provided at the time of application. Key terms applicable to membership:

  • Membership is personal and non-transferable
  • KYC (Know Your Customer) verification may be required before membership is approved
  • We Nation may suspend or terminate membership where these Terms or the Membership Agreement are breached
  • Membership fees, where applicable, are governed by the Membership Agreement

6. User Accounts

Where you create an account on the Platform:

  • You are responsible for maintaining the confidentiality of your login credentials
  • You accept responsibility for all activities conducted under your account
  • You must notify us immediately of any suspected unauthorised use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

7. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, icons, images, and software — is the property of We Nation South Africa (NPC) or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written consent from We Nation.

8. WhatsApp & Communication Consent

Where you provide your WhatsApp number and consent to receiving messages from We Nation:

  • We will only contact you via WhatsApp for the purposes you consented to (e.g. membership updates, events, campaigns)
  • You may opt out at any time by replying STOP
  • WhatsApp messages are governed by Meta's Terms of Service in addition to these Terms

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We Nation makes no warranties, express or implied, as to the accuracy, completeness, or reliability of any content on the Platform. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, We Nation South Africa, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

11. Third-Party Links

The Platform may contain links to third-party websites or services. We Nation is not responsible for the content, privacy practices, or terms of any third-party sites. Links do not constitute endorsement by We Nation.

12. Governing Law

These Terms are governed by and shall be construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the jurisdiction of the courts of South Africa.
